Terms of Service

These Terms of Service constitute a legally binding contractual agreement entered into between Ishant Enterprises (“Company”, “we”, “our”, or “us”), having its manufacturing infrastructure registered at RZ A1/C, Railway Colony, Pul Pehladpur, M.B. Road, New Delhi – 110044 and yards at Tughlakabad, New Delhi, and any corporate entity, procurement specialist, individual contractor, or website visitor (“Client”, “Buyer”, “you”).

By requesting price quotations, authorizing CAD fabrication schematics, executing Purchase Orders (PO), commissioning bespoke mobile cabins, or accessing https://ishantenterprises.com/, you unreservedly agree to be bound by these Terms. If you do not accept these terms in their entirety, you must refrain from issuing purchase commitments or utilizing our fabrication services.

Ishant Enterprises specializes in industrial-grade modular steel structures, prefabricated units, and bespoke container modification engineered for extreme environmental resilience. The scope includes, without limitation:

Each product is manufactured per the finalized technical bill of materials (BOM) agreed upon during the formal quotation phase.

All commercial estimates issued by Ishant Enterprises remain valid for a period of exactly 15 calendar days from the timestamp of quotation, owing to continuous commodity price fluctuations in hot-rolled (HR) and cold-rolled (CR) steel coils.

• Tax Invoicing (GST): All manufactured goods are invoiced with applicable Goods and Services Tax (typically 18% GST under prefabricated structural codes), with full tax credits extended to valid GSTIN holders.
• Currency: Commercial transactions are denominated and payable in Indian Rupees (INR) via verified RTGS, NEFT, or corporate clearing channels.
• Delayed Balances: Balances pending beyond 7 calendar days post-inspection shall incur structural yard storage charges of ₹1,500/day per 20ft container unit.

Prior to structural cut-out or welding, our in-house engineering drafting division provides a comprehensive 2D architectural blueprint and electrical wiring layout diagram.

Post-approval alterations requested during or after steel framing will incur supplementary line-item charges and extend the contractual delivery date commensurate with required rework.

Ishant Enterprises maintains ISO 9001:2015 certified fabrication quality management protocols. Every unit undergoes rigorous multi-stage quality assurance:

• Structural Chassis Inspection: MIG/TIG continuous weld seam checks on ISMC steel channels and heavy base runners.
• Water-Tight Hydro-Testing: High-pressure pneumatic/water deluge spray testing against corrugated roof sheets and exterior cladding joints to guarantee absolute leak resistance.
• Insulation Consistency: Infrared scanning across PUF (polyurethane foam), glass wool, or thermocol infill panels to eliminate thermal bridging.
• Factory Dispatch Inspection: Clients are encouraged to visit our Pul Pehladpur or Tughlakabad facilities for physical sign-off, or approve via HD video walk-through verification.

We coordinate pan-India trailer logistics via vetted heavy freight carriers. The operational terms governing transport include:

Demurrage: Delivery trailers must be released within 6 operational hours of arrival at client worksites. Unloading delays exceeding this threshold incur standard transporter detention charges billed directly to the Client.

Prefabricated cabins and container structures require a properly leveled, load-bearing plane to avoid torsional frame stress, door binding, or window seal failure over time.

• Base Engineering: Client must prepare flat PCC concrete pads, masonry pedestal footings, or hardened compacted gravel base prior to delivery.
• Clear Access Path: Client must ensure unhindered overhead clearance (min. 14.5 feet) free of low-hanging electrical power wires, tree limbs, and road obstacles.
• Utility Interconnects: Main exterior power cable drops, earthing pits, and municipal/septic plumbing connections are the Buyer’s licensed contractor responsibilities unless turnkey assembly was mutually contracted in the PO.

In the event of cancellation before physical steel alteration begins, Ishant Enterprises reserves the right to deduct architectural CAD design fees, raw-material allocation costs, and administrative expenses amounting to up to 25% of the initial deposit amount. Standard off-the-shelf security sentry booths (if uncustomized) may be eligible for store credit upon mutual executive agreement.

All structural shop drawings, architectural CAD elevations, website content, photography of completed fabrication projects, trademarks, and logo marks belong exclusively to Ishant Enterprises.

Clients are granted a non-exclusive license to use proprietary schematics solely for local site planning and internal project records. Disseminating our engineering drawings, load calculations, or fabrication joinery techniques to third-party competitors without written consent is strictly prohibited and subject to legal recourse under Indian IP statutes.

To the fullest extent permitted by law, Ishant Enterprises shall not be held liable for indirect, incidental, punitive, or consequential damages—including site work stoppage, commercial project liquidated damages (LDs), loss of profit, or equipment crane downtime—arising from delivery timelines or worksite operations.

Force Majeure: Ishant Enterprises shall not be held in breach of contract for fabrication delays or transit disruptions caused by events beyond reasonable industrial control, including heavy monsoon roadway closures, national steel mill allocation bans, government transport restrictions, regional labor strikes, border embargoes, or natural calamities.

Every standard cabin and container unit fabricated by Ishant Enterprises is covered by our defined manufacturing warranty:

Exclusions: Warranty does not cover chemical spillage, worksite accidents, improper craning, electrical voltage surges exceeding 240V, or unauthorized chassis modifications performed by non-certified personnel.

These Terms of Service and all related procurement orders shall be governed by, interpreted, and construed exclusively in accordance with the substantive laws of the Republic of India.

Any legal proceeding, dispute, claim, or controversy arising out of or regarding our fabrication contracts, deliveries, or payments shall be submitted to the exclusive jurisdiction of the competent civil courts located in New Delhi, India, with all other jurisdictional claims expressly waived by the Buyer.

Ishant Enterprises reserves the express right to amend, update, or substitute these Terms of Service at its sole discretion to reflect changes in industrial legislation, GST rate adjustments, or plant operational procedures.

Updated revisions will be posted directly to https://ishantenterprises.com/ alongside an updated “Effective Date”. Continued commercial engagement after revisions signifies complete acceptance of modified clauses.
